1. About Us

EnergyScan is operated by SCM Digitech Limited, a company incorporated in England and Wales with company number 14333758 ("we", "us", "our"). Our registered office address is available upon request. You can contact us at hello@energyscan.co.uk.

These Terms of Service ("Terms") govern your access to and use of the EnergyScan website at energyscan.co.uk and the web application at app.energyscan.co.uk (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. The Service

2.1 What EnergyScan does

EnergyScan provides an energy tariff comparison service. The Service allows you to upload an energy bill, from which we extract usage and tariff data using automated AI processing, and compare your estimated annual cost against publicly available energy tariffs from UK suppliers.

We offer two tiers of service:

2.2 Nature of the information provided

All information, comparisons, projections, and savings estimates provided through the Service are for general informational purposes only. They are based on data we extract from your bill and publicly available tariff information at the time of comparison. Actual costs may vary depending on your actual usage, supplier terms, standing charges, Direct Debit arrangements, and other factors.

EnergyScan does not provide regulated financial advice. We are not authorised or regulated by the Financial Conduct Authority (FCA). Nothing in the Service constitutes personal financial advice, an investment recommendation, or a substitute for professional advice. You should conduct your own research and satisfy yourself before making any switching decision.

2.3 Affiliate links and commission disclosure

The Service may contain links to third-party energy supplier websites. If you switch supplier by clicking a link on EnergyScan, we may earn a flat commission of £20 from the supplier. This commission is paid by the supplier at no cost to you. The commission is a fixed amount regardless of the tariff or supplier you choose, and does not influence which tariffs or deals we display. We disclose this on all switching links.

3. Eligibility

The Service is intended for use by individuals aged 18 or over who are resident in the United Kingdom. By using the Service, you confirm that you meet these eligibility requirements. We reserve the right to suspend or terminate access for users who do not meet these requirements or who provide false information.

4. Account Registration

4.1 Creating an account

To access the Premium subscription features, you must create an account by providing a valid email address and password. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must notify us immediately at hello@energyscan.co.uk if you suspect unauthorised use of your account.

4.2 Accuracy of information

You agree to provide accurate, current, and complete information when creating your account and when uploading bills. Inaccurate information may result in incorrect comparisons. We accept no liability for errors arising from inaccurate or incomplete data provided by you.

5. Subscription and Billing

5.1 Pricing

The Premium subscription is priced at £29 per year (inclusive of VAT where applicable) at the time of publication of these Terms. We reserve the right to change pricing with reasonable notice to existing subscribers. Changes to pricing will not affect your current billing period.

5.2 Payment processing

Payments are processed by Stripe, Inc., a third-party payment processor. By subscribing, you authorise us to charge your payment method through Stripe for the annual subscription fee. Stripe's own terms of service and privacy policy apply to the payment processing relationship. We do not store your payment card details.

5.3 Automatic renewal

Your subscription will automatically renew at the end of each annual billing period unless you cancel before the renewal date. We will charge the then-current annual subscription fee to your payment method on file. You will receive notification before renewal.

5.4 Cancellation

You may cancel your subscription at any time from your account dashboard or by contacting us at hello@energyscan.co.uk. Cancellation takes effect at the end of your current billing period. We do not offer refunds for unused portions of a subscription period except as required by applicable law or as set out in clause 5.5 below.

5.5 Statutory cancellation rights

If you are a consumer in the United Kingdom, you have a statutory right to cancel a contract for digital services within 14 days of purchase (the "cooling-off period") without giving a reason. However, by proceeding with your subscription and accessing the Premium features, you expressly request that we begin providing the service immediately. If you exercise your right to cancel within the cooling-off period having already accessed the service, we may charge you a pro-rated amount for the service provided up to the date of cancellation in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

5.6 Failed payments

If a payment fails, we will attempt to notify you by email. Access to Premium features may be suspended until payment is resolved. We reserve the right to cancel your subscription if payment remains outstanding.

6. Bill Upload and Data Processing

6.1 Bill files

The Service allows you to upload photographs or PDF copies of your energy bills. By uploading a bill, you grant us a limited, non-exclusive licence to process the file for the sole purpose of extracting tariff and usage data to provide the comparison service. Bill files are deleted immediately after processing and are not retained.

6.2 Extracted data

Extracted data (such as unit rates, standing charges, estimated annual usage, contract dates, and supplier name) is stored in your account profile to enable ongoing market monitoring and to improve the accuracy of comparisons over time. You may delete your account and all associated data at any time by contacting us at hello@energyscan.co.uk.

6.3 AI processing

Bill extraction is performed using automated AI processing. While we take reasonable steps to ensure accuracy, AI extraction is not infallible. You should review any extracted data for accuracy before relying on comparison results.

You agree not to use the Service to:

8. Intellectual Property

All intellectual property rights in the Service, including the website, application, software, algorithms, brand, design, and content, are owned by or licensed to SCM Digitech Limited. Nothing in these Terms grants you any right, licence, or interest in our intellectual property other than the limited right to use the Service as set out in these Terms.

You retain ownership of any data you upload to the Service. By uploading data, you grant us the rights necessary to provide the Service as described in clause 6.

9. Third-Party Services and Links

The Service integrates with or links to third-party services including Stripe (payment processing), Supabase (data storage), and Resend (email delivery), and energy supplier websites. We are not responsible for the content, practices, or availability of third-party websites or services. Links to energy suppliers are provided for convenience and do not constitute an endorsement of any supplier or tariff.

Third-party services are subject to their own terms of service and privacy policies. We recommend you review these before providing your information to any third party.

10. Disclaimers and Limitation of Liability

10.1 Service availability

We provide the Service on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or free from inaccuracies. We may suspend the Service for maintenance, updates, or reasons beyond our control without prior notice.

10.2 Accuracy of comparisons

Tariff data is sourced from publicly available information and is updated periodically. We do not guarantee that tariff data is current, complete, or accurate at the time of your comparison. Savings estimates are projections based on your usage data and available tariff information and may not reflect your actual savings if you switch. You should verify tariff details directly with the supplier before switching.

10.3 Limitation of liability

To the fullest extent permitted by applicable law, SCM Digitech Limited shall not be liable for:

Where liability cannot be excluded by law, our total aggregate liability to you in respect of any claim arising out of or in connection with these Terms or the Service shall not exceed the total subscription fees paid by you in the 12 months preceding the claim, or £100, whichever is greater.

10.4 Consumer rights

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms affects your statutory rights as a consumer.

11. Privacy and Data Protection

Our collection and use of your personal data is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy. We are registered with the Information Commissioner's Office (ICO) and comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

12. Changes to the Service and Terms

We may update these Terms from time to time. We will notify you of material changes by email to the address associated with your account and by updating the effective date at the top of this document. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the changes.

We may also modify, suspend, or discontinue any aspect of the Service at any time. Where we make material changes that adversely affect your use of the Service, we will provide reasonable notice.

13. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, your right to use the Service will cease immediately. Clauses that by their nature should survive termination (including those relating to intellectual property, limitation of liability, and governing law) will continue to apply.

You may terminate your account at any time by contacting us at hello@energyscan.co.uk. Termination does not entitle you to a refund except as set out in clauses 5.4 and 5.5.

14. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.

We encourage you to contact us at hello@energyscan.co.uk in the first instance if you have a complaint or dispute, and we will attempt to resolve it informally. If we are unable to resolve a dispute informally, either party may refer the matter to the courts of England and Wales, which shall have exclusive jurisdiction.

15. General

15.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SCM Digitech Limited in relation to the Service and supersede all prior agreements, representations, and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.

15.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor in connection with a merger, acquisition, or sale of assets, provided we give you reasonable notice.
